ONG´s ambientalistas demandan al Gobierno ante Tribunales «por inacción ante el cambio climático».
Las ONG´s ambientalistas, Greenpeace, Ecologistas en Acción y Oxfam Intermón, interpusieron una demanda vía judicial ante la Sala de lo Contencioso-Administrativo del Tribunal Supremo de España.
Su lucha contra el cambio climático ha sido el principal objetivo del movimiento por parte de las organizaciones ecologistas.
Esta sería la primera demanda contra el Gobierno español, por su nulidad de actuación e implementación de políticas públicas, ante la constante pasividad frente a la amenaza del cambio climático.
Con este recurso las organizaciones quieren mostrar los efectos, que tendrá el cambio climático principalmente en su lugar de actuación: España.
Si el Gobierno no lleva a cabo las medidas necesarias como reducir los gases de efecto invernadero, en por lo menos un 55% para el año 2030, y emisiones cero para el año 2040, se verían responsables por la desprotección de los derechos fundamentales a la salud y la vida de la ciudadanía, que necesitan de un medio ambiente adecuado para poder disfrutarse plenamente.
Las organizaciones señalan que el Plan Nacional Integrado de Energía y Clima (PNIEC) y la Estrategia a Largo Plazo (ELP) impulsadas por el Gobierno, no sólo incumplen el Reglamento (UE) 2018/1999, sobre la gobernanza de la Unión de la Energía y de la Acción por el Clima, sino también los compromisos asumidos por España con la ratificación del Acuerdo de París y las recomendaciones científicas del Panel Intergubernamental del Cambio Climático de Naciones Unidas (IPCC) para no superar el calentamiento global al 1.5 ºC.
Mario Rodríguez, director de Greenpeace en España, ha señalado que para evitar un cambio climático devastador sólo hay una vía: reducir drástica y rápidamente las emisiones de CO2 y acelerar la transición ecológica, lo que requiere de decisiones políticas y judiciales valientes.
Otros países como Estados Unidos, Canadá, Alemania, Francia, Bélgica, India o Nueva Zelanda ya se enfrentan procesos judiciales similares.
En el caso de Holanda, la Fundación URGENDA ha logrado una sentencia del Tribunal Supremo que condena al ejecutivo holandés por incumplir los compromisos previamente adquiridos en relación con la mitigación climática.
